Terms of Service

1. Acceptance of Terms

By accessing or using Summarsky ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Summarsky. You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. To purchase credits or subscriptions you must be at least 18 years old or the age of majority in your jurisdiction.

2. Description of Service

Summarsky is an AI-powered book summarization platform. Users upload supported book files (EPUB, DOCX, ODT, RTF, Markdown, TXT, HTML) and the Service generates chapter-by-chapter summaries, running narrative summaries, and character or setting intelligence using automated AI processing.

The Service operates on a credit-based model. Credits are consumed when books are processed. A limited number of free credits are provided monthly; additional credits are available through paid subscription plans or one-time top-up purchases.

We reserve the right to modify, suspend, or discontinue any feature or the Service as a whole at any time, with or without notice. We will make reasonable efforts to notify users of material changes to core functionality.

3. User Accounts

You must create an account to access most features of the Service. Accounts are created using Google Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to notify us immediately at support@summarsky.com if you suspect any unauthorized use of your account.

You may not share your account credentials, create accounts on behalf of others without authorization, or operate multiple accounts to circumvent credit or usage limits. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Upload content you do not have the legal right to process, reproduce, or distribute;
  • Upload content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any party;
  • Upload content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable;
  • Attempt to circumvent credit limits, subscription restrictions, or access controls;
  • Reverse-engineer, scrape, or systematically extract data from the Service;
  • Use the Service in any manner that could damage, disable, or impair its infrastructure;
  • Use automated tools, bots, or scripts to interact with the Service without prior written permission.

We may remove content, suspend accounts, or take other remedial action at our sole discretion for violations of this section.

5. Intellectual Property

5.1 Your Content

You retain ownership of any book files you upload ("User Content"). By uploading User Content, you grant Summarsky a limited, non-exclusive, royalty-free license to process, store, and display that content solely to provide the Service to you. This license ends when you delete your content or close your account.

You represent and warrant that you hold all necessary rights to upload and authorize the processing of your User Content and that doing so does not violate any third-party rights or applicable law.

5.2 AI-Generated Summaries

Summaries, synopses, character profiles, and other outputs generated by the Service ("Generated Content") are produced algorithmically from your User Content. To the extent permitted by applicable law, you own the Generated Content associated with your account. Summarsky retains no claim to Generated Content beyond what is necessary to operate the Service.

5.3 Summarsky IP

The Service, including its software, design, branding, and documentation, is owned by Summarsky and protected by intellectual property laws. Nothing in these Terms grants you any right to use Summarsky's name, logo, or trademarks without our prior written consent.

5.4 Public Library

If you choose to publish a book to the public library, you grant Summarsky and other users a non-exclusive, royalty-free right to view and read the associated summaries and Generated Content on the Service. You may remove a book from the public library at any time, though cached or previously viewed content may not be immediately purged from all systems.

6. AI Processing Disclosure

The Service uses third-party AI models (currently accessed via OpenRouter) to generate summaries and other outputs from your uploaded content. By using the Service, you acknowledge and agree that portions of your User Content — specifically the extracted text of chapters — will be transmitted to these third-party AI providers for processing. We do not transmit your personal account information alongside your book content during AI processing.

AI-generated outputs may contain inaccuracies, omissions, or errors. We do not guarantee the accuracy, completeness, or quality of any Generated Content. Generated Content should not be relied upon as a complete or authoritative substitute for reading the original work.

7. Credits, Subscriptions, and Billing

7.1 Free Credits

All accounts receive a monthly allocation of free credits. Free credits reset on a 30-day cycle and do not roll over. The size of the free credit allocation may change at our discretion; we will provide reasonable notice of reductions.

7.2 Paid Subscriptions

Paid plans are billed on a recurring monthly or annual basis via Stripe. Subscription charges are made at the start of each billing period. You authorize us to charge your payment method on file for the applicable subscription fee. You may cancel your subscription at any time; your access to paid features will continue until the end of the current billing period. We do not provide prorated refunds for unused subscription time unless required by applicable law.

7.3 Credit Top-Ups

One-time credit top-up packages are non-refundable and do not expire while your account remains active. Top-up credits are consumed after your monthly credit allocation is exhausted.

7.4 Credit Consumption

Credits are reserved before a processing job begins and settled upon completion. If a job fails or is canceled, reserved credits are refunded in full or in part depending on how much processing occurred. Credit costs are calculated based on the estimated number of AI tokens required to process your book.

7.5 Price Changes

We reserve the right to change subscription prices and credit package pricing. We will provide at least 30 days' notice of price increases to active subscribers via email. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.

7.6 Taxes

Prices displayed may exclude applicable taxes. You are responsible for any taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service. Stripe may collect taxes on our behalf where required by law.

8. Termination

You may close your account at any time by contacting us at support@summarsky.com. Upon closure, your data will be deleted in accordance with our Privacy Policy. Unused credits and remaining subscription time are forfeited upon voluntary account closure.

We may suspend or terminate your account and access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users. In such cases, we are not obligated to refund any credits or subscription fees.

Sections 5, 6, 9, 10, 11, and 12 survive termination of these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY GENERATED CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMARSKY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Summarsky and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your User Content, your use of the Service, or your violation of these Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration or, where arbitration is not permitted, to the courts of competent jurisdiction. You agree to first attempt to resolve any dispute informally by contacting us at support@summarsky.com.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
